June 3, 2010 - ACS Seminar

On June 3, 2010, ACS, LLP held its annual seminar at the Hilton Hotel in Newark. The seminar included noted physicians, top vocational experts, and well-respected Applicant attorneys.

Our deepest thanks to Drs. S. Feinberg, M.D., F. Newton, M.D., J. Kirz, M.D., and L. Lin, M.D., for their medical expertise in addressing Almaraz/Guzman and apportionment.

We also thank Mr. Alex Wong, Esq., and Mr. Ray Frost, Esq. for their contribution, comments, and insights on the multitude of issues from the applicant’s perspective.

We are also indebted to Mr. Scott Simon, M.S., C.R.C. for his time in providing his thoughts on Ogilvie, and to Ms. Gina Loukedis, M.S., C.R.C. for her thorough and timely presentation on FEHA and the various obligations inherent in the return-to-work process.

The feedback so far is that the panel configuration facilitated a balanced and fair treatment of the issues. The speakers’ presentations were superb, and the seminar we believe was an all-around success.

During the day, there were many highlights. For example, at near the end of the seminar, we learned that the Appeals Board had struck down Rule 30(d)(3) in the en banc decision Mendoza; coincidentally, that very morning Mr. Bill Armstrong commented that Rule 30(d)(3) is inconsistent with Labor Code section 4060.
